This is my Hobby

I only do it for personal enjoyment and to help make the Internet a better place. I do, however, accept donations to help with the cost of hardware, software or other tools so that I may provide this service to non-profit organizations or others who may not be able to afford it.

Acceptance of Terms

*G4C Web Design reserves the right to refuse, cancel, or suspend service at my sole discretion.

G4C Web Design Services provides its service to you, subject to the following Terms of Service ("TOS"). G4C Web Design Services reserves the right to add, delete, or modify any provision of its TOS at any time without notice. You can review the most current version of the TOS at any time on our web site at http://www.g4cwebdesign.com/.

Authorization

G4C Web Design Guests (hereinafter referred to as "Guest") is engaging G4C Web Design. (hereinafter referred to as "G4C Web Design"), as a design hobbyist for the specific purpose of designing a World Wide Web site (hereinafter referred to as "Web Design Project") to be published on the Guest’s account on an Internet Service Provider(ISP)/Web Presence Provider(WPP) computer, hereinafter refer to as "Hosting Service", or provided on diskette at the Client's option. The Client hereby authorizes G4C Web Design to access this account, and authorizes the Hosting Service to provide G4C Web Design and its owner Greg Fulmer with "full access" to the Guest's account, and any other programs needed for this Web Design Project that are included as part of the Guest’s service agreement/level. The Client also authorizes G4C Web Design to submit the completed Web Design Project to major Web Search Engines.

Ownership Rights

Guests shall retain all of its intellectual property rights in any text, images or other components it owns and transmits to Developers for use in the Web Site. Guest shall hold the copyright for the agreed upon version of the Web Site as delivered, and Guest’s copyright notice may be displayed in the final version.

Copyrights:

The guest hereby unconditionally guarantees that all text, graphics, photos, trademarks, designs and any other materials provided to G4C Web Design by the guest are either owned by the guest, or used by permission of the owners of said materials. The guest agrees to hold harmless, protect and defend G4C Web Design from any claim or suit arising from the use of these materials. Similarly, G4C Web Design warrants that all graphics and text supplied by G4C Web Design for use in the construction of the site are either owned by G4C Web Design or used with permission.

Content:

G4C Web Design is committed to providing a family friendly environment on the web. I am strict about acceptable content because of this commitment. Never before have we been so bombarded with pornography and morally degrading material than by way of the Internet. I want no part of it.

All services provided by G4C Web Design may be used for lawful purposes only. Transmission, storage or presentation of any information, data or material in violation of any United States Federal, State or City law is prohibited. This includes, but is not limited to: fraudulent material, copyrighted material, material I judge to be threatening or obscene or material protected by trade secret and other statute. The subscriber agrees to indemnify and hold harmless G4C Web Design from any claims resulting from the use of the service which damages the subscriber or any other party.
All pornographic content and sex-related merchandising is prohibited on all G4C Web Design sites, whether legal or illegal. This includes sites that may infer sexual content or links to adult content elsewhere. In addition, sites containing profanity or vulgar language are also prohibited.

Sites that promote any illegal activity or present content that may be damaging to G4C Web Design Sites or any other server on the internet are prohibited. Links to such materials are also prohibited. Examples of this material include pirated software, hacker programs or archives, and warez sites.
It is also prohibited to engage in activities, whether lawful or unlawful, that G4C Web Design determines to be harmful to its subscribers, operations, reputation, goodwill, or customer relations.
G4C Web Design will be the sole arbiter as to what constitutes a violation of these provisions.

Time Frame of completion:

G4C Web Design and the guest must work together to make a website become reality . The guest must supply G4C Web Design with any specific text, graphics, or other specific items for inclusion in a timely manner, unless agreed otherwise. Because G4C Web Design is simply a hobby there are absolutely no guarantees of work completion by any certain date.

Backups:

G4C Web Design does not backup data (unless you request this). It is the guests responsibility to maintain local copies of their web content and information.

G4C Web Design Links

Any or all web designs completed by G4C Web Design will include a small graphic or text link along with your copyright. This link will lead back to the G4C Web Design Website

GUEST CONDUCT

You are solely responsible for the contents of your transmissions through G4C Web Design. Your use of the G4C Web Design service(s) is subject to all applicable local, state and national laws and regulations. You agree: (1) to comply with US law regarding the transmission of technical data exported from the United States through G4C Web Design; (2) not to use G4C Web Design for illegal purposes; (3) not to interfere or disrupt networks connected to the G4C Web Design; and (4) to comply with all regulations, policies and procedures of networks connected to G4C Web Design. You agree not to transmit through G4C Web Design service(s) any unlawful, harassing, libelous, abusive, threatening, harmful, or otherwise legally objectionable material of any kind or nature. You further agree not to transmit any material that encourages conduct that could constitute a criminal offense, give rise to civil liability or otherwise violate any applicable local, state or national law or regulation. Attempts to gain unauthorized access to other computer systems are prohibited. You shall not interfere with another customer's use and enjoyment of the G4C Web Design service(s) or another entity's use and enjoyment of similar services. G4C Web Design may, at its sole discretion, immediately terminate your service or any agreement with us should your conduct fail to conform to these terms and conditions.

Limitation of Liability:

G4C Web Design makes no guarantee of availability of service and reserves the right to change, withdraw, suspend, or discontinue any functionality or feature of the G4C Web Design Services.

IN NO EVENT WILL G4C WEB DEDIGN BE LIABLE FOR ANY
DAMAGES, INCLUDING, WITHOUT LIMITATION, DIRECT,
INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR
PUNITIVE DAMAGES ARISING OUT OF THE USE OF OR
INABILITY TO USE DAVESTUFF.US SERVICES OR ANY
CONTENT THEREON. THIS DISCLAIMER APPLIES, WITHOUT
LIMITATION, TO ANY DAMAGES OR INJURY, WHETHER FOR
BREACH OF CONTRACT, TORT, OR OTHERWISE, CAUSED BY
ANY FAILURE OF PERFORMANCE; ERROR; OMISSION;
INTERRUPTION; DELETION; DEFECT; DELAY IN OPERATION OR
TRANSMISSION; COMPUTER VIRUS; FILE CORRUPTION;
COMMUNICATION-LINE FAILURE; NETWORK OR SYSTEM
OUTAGE; OR THEFT, DESTRUCTION, UNAUTHORIZED ACCESS
TO, ALTERATION OF, OR USE OF ANY RECORD.

Your use of G4C Web Design are at your sole risk. All G4C Web Design services are provided on an "AS IS" basis WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESSED, IMPLIED, CONSTRUCTIVE, OR STATUTORY, INCLUDING, WITHOUT LIMITATION, ANY IMPLIED WARRANTIES OF MERCHANTABILITY, NON-INFRINGEMENT OR FITNESS FOR A PARTICULAR PURPOSE.

Failure to follow any term or condition will be grounds for immediate account deactivation.
G4C Web Design reserves the right to change or amend these Terms of Service at any time without prior notice. By allowing G4C Web Design to build a web site signifies your agreement to these Terms of Service.
